User Agreement

PART-Y PLATFORM USERS’ RIGHTS AND OBLIGATIONS

1. PARTIES

On one side of this Agreement is Dotneed Digital Solutions Information Technologies Tourism Trade Limited Company, located at Pınarbaşı Neighborhood, Hürriyet Street, Akdeniz University Ulugbey AR-GE 2 No:3 A, Konyaaltı/Antalya (hereinafter referred to as “Part-y”), and on the other side is the individual who has become or will become a member of the Part-y application owned by Part-y (hereinafter referred to as the “Application”) (hereinafter referred to as the “Member”). This Agreement has been prepared to determine the rights and obligations of the parties and the terms of use of the services and content offered through the Application.

2. DEFINITIONS

The definitions of the terms used in this Agreement are as follows:

Part-y:
Part-y is an AI-powered platform that digitalizes part-time job postings and recruitment processes and matches employers with job seekers.

Application:
The mobile software of the platform named Part-y that brings employers and job seekers together.

User:
Any real or legal person accessing the Application via an online environment.

Member:
Real and/or legal persons who benefit from the services offered within the Application under the terms specified in this Agreement.

Membership:
Membership is completed by filling out the membership form required to become a Member via the relevant section of the Portal, providing identity information, confirming the accuracy of such information, and having the registration approved by Part-y. Without completing the membership process, the rights and authorities defined for “Members” under this Agreement cannot be acquired.

Portal:
Refers to the website located at https://part-y.io and all mobile applications owned by Part-y.

3. SERVICES TO BE PROVIDED BY PART-Y

Part-y shall provide the following services to Members who approve this Agreement through the Application:

• Sharing information and content related to Part-y’s activities,
• Sharing up-to-date information regarding event programs, news related to Part-y, event calendars, event content, publications related to its field of activity, and similar content,
• Sending newsletters to the email address provided by the Member,
• Conducting surveys to measure Member satisfaction with Part-y’s products and AI-powered employer–worker matching services, to gather opinions on new services, and to improve service quality,
• Carrying out membership transactions within the Application; collecting the Member’s personal information (name, surname, trade name if any, email, date of birth, and mobile phone number), storing such data securely, and enabling updates to this information upon the Member’s request or when deemed necessary by the Application for security purposes.

4. APPLICATION MEMBERSHIP SYSTEM

• To become a Member, the User must accurately complete the Membership Form published within the Application and agree to comply with the provisions of this Membership Agreement.
• The User clicks either the “Sign Up” or “Cancel” button under the Registration Form. By clicking “Sign Up,” the User is deemed to have accepted the terms of this Agreement.
• The Member is assigned a “Username” and “Password” required to perform certain transactions within the Application.
• The Username is unique to the Member and cannot be assigned to more than one Member. The Password is known only by the User and may be changed at any time. The selection and protection of the Password are entirely the User’s responsibility. Part-y shall not be liable for any errors or problems arising from user-related password misuse. If the Password is entered incorrectly three consecutive times, the User is redirected to the “Forgot Password” section and required to complete security steps to define a new password.
• The Member accepts that all information provided to Part-y during and after registration is accurate, current, complete, and shared with Part-y with the Member’s consent.
• The Member declares that they are at least 16 years of age to use the Application.
• Without Part-y’s explicit written consent, Members may not rent, share, or grant access to their accounts. Otherwise, the Member accepts full responsibility for any direct or indirect damages incurred by Part-y.
• Creating accounts with incorrect information, including on behalf of individuals under 16 years of age, constitutes a violation of Part-y’s terms.

5. MEMBER OBLIGATIONS

The Member agrees and undertakes that:

• The information provided in the Membership Form is accurate and that the Member bears responsibility for any damages arising from incorrect or incomplete information, which may result in termination of membership,
• All copyrights of the services and software provided through the Application belong to Part-y and/or licensors or content providers and are protected under intellectual property laws; any violation will result in legal and criminal liability,
• Any personal opinions, content, files, or materials shared via the Application are the sole responsibility of the Member, and Part-y shall not be held liable,
• No software or materials that may harm the Application or cause disputes with third-party platforms shall be shared or stored,
• Part-y shall not be responsible for lost, incomplete, or misdirected information, messages, files, or location data due to incorrect addresses,
• The Member shall not access services in unauthorized ways or alter software or service features,
• Part-y shall not be liable for damages caused by unauthorized access due to the Member’s negligence,
• The Member shall not send threatening, immoral, racist, discriminatory, or unlawful content,
• Communications between Members must comply with general morality, etiquette, and legal standards,
• Other Members shall not be harassed or threatened,
• Services shall not be disrupted or other users’ systems damaged,
• All data obtained through Part-y services is used at the Member’s own risk, and no compensation shall be claimed from Part-y,
• Prohibited content, chain emails, or viruses shall not be distributed,
• Personal data of others shall not be misused or recorded without consent,
• The Member is personally responsible for all actions performed using their Username,
• Even if membership is terminated unilaterally, the Member remains fully responsible for all actions performed prior to termination.

6. RIGHTS AND AUTHORITIES GRANTED TO PART-Y

Part-y may suspend or terminate the Application temporarily or permanently at any time without liability. Part-y reserves the right to monitor the system, intervene in violations, suspend or terminate membership, offer paid membership models, and modify or discontinue services.

7. MEMBER DATA, NEWSLETTERS, AND PRIVACY

Part-y collects certain personal data to provide better services. Such data is used solely for service delivery, communication, announcements, and marketing activities in accordance with Member preferences and is not shared with third parties except where legally required.

Members consent to receiving commercial electronic messages and may opt out at any time via the unsubscribe option.

8. VALIDITY OF PART-Y RECORDS

In disputes arising from this Agreement, Part-y’s records shall constitute definitive evidence under Article 193 of the Turkish Code of Civil Procedure.

9. FORCE MAJEURE

Force majeure includes events beyond Part-y’s control such as natural disasters, strikes, infrastructure failures, internet outages, and similar circumstances. Part-y shall not be held liable for non-performance due to force majeure.

10. GOVERNING LAW AND JURISDICTION

Turkish law shall apply, and Antalya Courts shall have jurisdiction over disputes.

11. NOTIFICATIONS

The email address provided by the Member shall be deemed the legal notification address unless updated in writing within three days.

12. EFFECTIVE DATE

This Agreement enters into force upon clicking the “I Accept” button and remains effective indefinitely.

13. TERMINATION

Either party may terminate this Agreement at any time.
